Important Updates – Mining Regulations Amended

IMPORTANT UPDATES – MINING REGULATIONS AMENDED
The Minister of Minerals recently made several amendments to the Regulations affecting mineral rights
in Tanzania. One of the laws affected is the Mining (Mineral Rights) Regulations of 2018 (Mineral
Rights Regulations).

  • The Mineral Rights Regulations has introduced several amendments as stated hereunder;
    All mineral license holders are required to possess and use more than one Point of Sale Machine
    (POS Machine) within the licensed area.
  •  All applications for transfer and assignment of a mineral rights shall be made to the Mining
    Commission in Form No. MRF 15.
    The Point of Sale Machine (POS Machine) has been defined to mean an electronic device used for
    capturing industrial and building materials, production records and sell transactions.

 

Also, the Mining (Minerals and Mineral Concentrate’s Trading) Regulations of 2018 has been amended
by the Mining (Minerals and Mineral Concentrate’s Trading) (Amendment) Regulations of 2022 as
follows:

  • All persons intending to process tailings shall be required to enter into an agreement with a
    mineral right holder and have the agreement registered at the Mining Commission.
  • Transportation of tailings is subject to a permit from the Mining Commission
  • Transporting of tailings without permit will attract a fine of TZS Two million or six months
    imprisonment and five million or twelve months imprisonment in case of loaded carbon.
  • Sale or removal of building materials or construction leftovers shall be carried out with a permit
    from the Mining Commission.
  • Applications for a broker license for building or industrial materials shall be made to the
    Commission via Form No. MTF. 9
